1. Our commitment
VISMARKS complies with the Nigerian Copyright Act 2022 (including its notice-and-takedown provisions), the Trade Marks Act, and acts in the spirit of the US DMCA and the EU Digital Services Act for international rights holders. We remove infringing listings and content promptly when properly notified, and we close the accounts of repeat infringers.
2. How to send a notice
Email ip@vismarks.com (or use the Report link on the listing/Stage) with:
- Your name, company, address, email and phone, and your relationship to the rights holder (owner or authorised agent, with evidence of authority).
- Identification of the work or mark claimed to be infringed (registration numbers, links to the original, or copies).
- The exact URLs of the listings, videos, replays, images or Stage content you want removed.
- A statement that you believe in good faith the use is not authorised by the rights holder, its agent or the law.
- A statement, under penalty of perjury or equivalent, that the information is accurate and you are authorised to act.
- Your physical or electronic signature.
Incomplete notices may be rejected or delayed while we ask for the missing information.
3. What we do with a notice
- We review within 2 business days of receiving a complete notice; clear counterfeit or piracy cases are usually removed within 24 hours.
- We remove or disable the content and notify the seller/creator with a copy of the notice (your contact details are shared so the parties can resolve it).
- We record a strike against the account and may hold related payouts pending resolution.
- We may also remove the content from feeds, highlights and social channels and request removal from search engines.
4. Counter-notice
If your content was removed by mistake or misidentification, send a counter-notice to ip@vismarks.com with: your contact details; the removed content and its former URL; a statement under penalty of perjury that you believe in good faith it was removed by mistake; your consent to the jurisdiction of the courts of Lagos State, Nigeria (and, for foreign rights holders, of the courts where you reside); and your signature. We forward it to the claimant. Unless they tell us within 10 business days that they have started legal action, we may restore the content.
5. Repeat infringers
6. Counterfeits and brand owners
- Counterfeit, replica, 'AAA', 'mirror quality', 'inspired by' and unauthorised branded goods are banned outright, whether or not a brand complains.
- Sellers may be asked at any time for invoices, authorisation letters or authenticity proof. Failure to provide them within 5 business days results in removal.
- Brand owners can enrol in our Brand Protection programme (email ip@vismarks.com) for a verified reporting channel, bulk takedowns and proactive keyword monitoring.
- We cooperate with customs, the Nigerian Copyright Commission, the Standards Organisation of Nigeria and equivalent authorities abroad.
7. Music and audio on Stage
Commercial recordings in videos and live shows are not permitted without a licence. Rights holders may request muting, removal or geo-blocking. Creators should use their own music or the licence-free beds provided in Stage Studio. Repeated music claims count as strikes.
8. False or abusive notices
Knowingly false notices or counter-notices may make you liable for damages, including the other party's costs, and may lead to closure of your own account and exclusion from the Brand Protection programme. Do not use the notice process to suppress legitimate competition, fair use, parody or criticism.
